Terms & Conditions for Uni Cycle Solutions Services

Please read terms and conditions carefully

 

  1. General

    1.  These Terms and Conditions apply to using the Service provided by Uni Cycle Solutions Limited (UCS).

    2. The Service is using the smart bicycle racks provided by UCS for parking bicycles (The “Racks”).

    3. UCS provides access to and use of the smart bicycle racks via the use of a Mobile Application (The “App”) which also includes the display of free, reserved and busy bicycle rack spaces on the Map, and the payment system for the services provided.

    4. The User is defined as the person who uses the service UCS provides.

    5. On the basis of this Agreement, UCS grants the User the right to use the Services provided by UCS (Smart Bicycle Racks and mobile App).

    6. UCS offers bicycle parking and does not assume responsibility for stolen bicycles or damaged bicycles.

    7. UCS offers safe bicycle parking and does not assume responsibility for abandoned bicycles.

    8. In addition to the Terms and Conditions, legal relations arising from this Agreement shall be governed by legislation regulated in the United Kingdom.

 

2. Parking conditions:

 

  1. Parking session is the time the bicycle is parked in the Racks.

  2. The parking begins when the User notifies the start of parking via Mobile App.

  3. The Parking time ends when the User notifies the end of the parking by the Mobile App.

  4. When the parking time is over, the User is obliged to pay the applicable fees (if any) and remove the bicycle from the Rack.

  5. The User can reserve a parking place in the bicycle Rack via Mobile App in the terms and conditions determined thereof. The maximum reservation time and related fees are (if any) will be displayed in the App.

  6. The maximum continuous parking time in the same Rack is (7 days). 24 hours before the maximum parking time will expire, the owner of the bike will receive a notification via App, requiring releasing the bike within the next 24 hours.

  7. Shall the maximum time have expired, the bicycle will be removed from the Racks by the [owner/lessee, and stored for a maximum period of X weeks. During that period the owner of the bike will be able to recover the bike for a handling fee of X€. Once the maximum storage period has expired the owner/lessee will not have any obligation in relation with the bike.]

 

3. The UCS App

 

  1. UCS App enables the User requiring a Bicycle Rack service to find and access a suitable Bicycle Rack location.

  2. In order to use the Service, the user must download and launch the mobile App, submit the requested information and start the Service.

 

4. UCS App registration:

 

  1. The use of the UCS App requires installation of UCS App and registration of a user account. During the installation of the UCS App, the user is linked to the respective user account and added to the UCS’s database.

  2. In order to complete the registration process and provide the Services the User has to provide UCS with true and complete information about the User (the User Data) and keep it updated.

  3. UCS has in place the security measures to protect your account against unauthorised access and misuse. Notwithstanding the above UCS can not guarantee the absolute security of your account nor its contents against the attacks of external hackers that could illegally access the App or its contents. The User accepts to notify as soon as possible all unauthorised use of the User’s account.

  4. In order to provide the Services, it’s necessary to process your data in order to improve the Services and to develop new functionalities and services.

  5. The User agrees that UCS may request and collect additional information of the User, technical data and related information (including but not limited to technical information) about the use of the Services, the device of the User, system and application software, and peripherals, that is gathered periodically to facilitate the provision of software updates, product support and other services to the User (if any) related to the Applications. UCS may use this information, as long as it is in a form that does not personally identify the User, to improve its products or to provide services or technologies to the User.

  6. During the registration of when using the UCS App  the user can choose whether he/she wishes to pay for the service with a bank/credit card or prepaid account.

 

5. UCS payment conditions:

 

  1. Shall the user of UCS App decide to pay for the Service with a credit card, it will require the prior activation of the credit card data within the app and acceptance of UCS Terms and Conditions.

  2. Prepaid account payments can be made by a user that has purchased prepaid credit.

  3. In case a service fee is added, when making credit card payments, the amount of the service fee is displayed in the mobile app.

  4. UCS will offer card owners support in solving the problems that could arise in the card payments process. The resolution of credit card payment related disputes also takes place through UCS.

  5. When offering credit card payments, UCS intermediates payments made in the UCS App. The obligation of the customer in front of the service provider shall be considered fulfilled as of the moment when the payment order is made for the payment of funds into UCS bank account. UCS shall not be responsible for the exercise of the customer’s payment order.

  6. UCS shall resolve all credit card payment related complaints and applications within X business days.

 

6. Refund policy and cancellation policy:

 

  1. The User of UCS is responsible for the timely payment of all fees and for providing UCS with a valid payment method for payment of all fees.

  2. Prices for services offered via the UCS app may change at any time, and UCS does not provide price protection or refunds in the event of a price reduction or promotional offering.

  3. If technical problems prevent or unreasonably delay delivery of the service, the Users’ exclusive and sole remedy is either replacement or refund of the price paid, as determined by UCS.

  4. By using the Services, User agrees that they are responsible for any and all fees charges and costs that the service provider charges for their mobile phone or mobile device service.

  5. After the User of UCS notifies UCS of any suspected error or unauthorized transaction, or UCS otherwise learns of one, UCS will conduct an investigation to determine whether there has been an error or unauthorized transaction that is eligible for refund. UCS will complete the investigation within 30 days of the date UCS received the users notification.

  6. If UCS determines that there was an error, UCS will promptly credit the full amount of the error into the User’s account within 1 business day of determination.

7. By registering an account with UCS, a customer shall accept the following conditions

 

  1. UCS shall have the right to add the personal data of the User to UCS database and to store and treat for the purposes related to the Services in accordance with UCS´s Privacy Policy.

  2. UCS shall have a right to make unilateral amendments to the Terms and Conditions and Privacy Policy. UCS shall notify the users of changes to Terms and Conditions and Privacy Policy.

  3. UCS shall be entitled to forward personal data and bank data to credit card payment intermediaries.

 

8.Good practice of using UCS

 

  1. UCS is committed to contributing to improvement of the quality of services. For this reason, we might ask Users to fill out a feedback form in the UCS App.

  2. We expect that the users of UCS use the Services in good faith and are respectful of the Bicycle Racks that offer their Services through UCS. Otherwise we could cancel your UCS account.

 

9. Other Conditions

 

  1. To provide the service UCS needs to process the User’s personal data. When downloading and launching the mobile application for the first time, the User confirms that he / she has familiarized himself / herself with the terms of processing personal data of UCS and agrees with UCS processing his / her personal data in accordance with the conditions of processing personal data of UCS. Consent can be withdrawn. In case of withdrawal of consent, UCS has the right to suspend the provision of the Service.

  2. All complaints can be sent to our support team via email hello@unicycle.solutions (available on workdays 09.00-17.00 BST).

  3. All enquiries or emergency support can be accessed by calling the emergency support team via telephone +44(0)7599943781.

  4. These Terms & Conditions will remain applicable unless some changes are notified by UCS to the Users via App. UCS has the right to unilaterally amend these Terms and Conditions and their actual implementation.
